Terms and Conditions


The Next Stop: San Diego (NSSD) Short-Term Rental Agreement is a legally binding agreement made and entered into as of the Reservation Date indicated on the booking confirmation, by and between Property Representative (NSSD) and the Primary Guest(s). Guest has agreed to rent the described residence for the duration of the Lease Term for the Total Rental Fee, and within the statedTerms & Conditions outlined on the Booking Confirmation.

Occupancy by Guest & Authorized Guests

In addition to Guest identified as Primary Contact, only those guests listed on the booking confirmation shall reside at the Property. No other overnight guests are permitted unless agreed upon in writing prior to arrival. If Property is used by more or different persons than those identified on the reservation, Guests are in breach of Agreement and may be required to vacate premises immediately.

Check-In & Check-out

Check-In as early as 4PM
Check-Out before 10AM

Early Arrivals & Late Departures

If available, a guaranteed early check-in or late check-out can be confirmed for 50% of the nightly rate plus taxes. Contact NSSD

Payment Schedule

A 50% Advanced Reservation deposit and signed rental agreement are required to hold reservation. The Remaining Balance is due 30 days prior to arrival. Reservations made within 30 days of arrival require full payment, along with a signed rental agreement, for confirmation.

Payments Accepted

Payment can be made by check (drawn on a US bank account) or by credit card. If a check is returned for non-sufficient funds, Guest shall pay a $25.00 NSF Fee. An NSF check may result in cancellation of this Agreement if required payments are not received by the applicable Due Date(s).

Security Deposit

Reservation confirmed through third-party websites (HomeAway/VRBO, TrpAdvisor and Airbnb) will be charged a refundable security deposit, which will automatically be refunded within 10 days of their departure providing there were no reported damages.

Guests booking directly with NSSD will not be charged a refundable security deposit, but remain responsible for any damages caused during their stay.

Cancellation Policy

All cancellations must be in writing. There shall be no refunds due to shortened stays or ruined expectations caused by weather conditions, work and family emergencies, or other commitments.

Optional TRAVEL INSURANCE can protect your vacation investment from unforeseen circumstances that require you to cancel your trip or if you experience travel delays, lost luggage, or medical emergencies.

Authorized Use

The Property is for the sole use as a short-term, personal vacation residence.Guest expressly acknowledges and agrees this agreement is for short-term, personal occupancy of the Property as a transient lodger for the duration of nights shown on reservation. Owner retains full legal, possessory and access rights of Property.

Maximum Occupancy

Unless agreed upon in writing, Guest agrees that no more than the maximum number of guests stated on the booking confirmation, (including adults, teens, children, toddlers and infants) shall be permitted on the Property at any time during the Rental Term, all of whom shall comply with the Terms & Conditions of this Agreement.

Smoking Policy

Smoking is NEVER allowed inside Properties. Certain properties also prohibit smoking anywhere outside. If allowed, Guests may smoke outside if they dispose of ashes & butts in the ashtrays provided – refer to property description.

Pet Policy

Renter agrees that no pets shall be allowed in the rental home or on the property at any time.


The Property is provided in “as is” condition. Property Owner shall use best efforts to ensure the operation of all amenities, such as appliances, utilities (electric, gas, water, trash, sewer), internet access, satellite TV, or fireplace, as applicable. Property Owner shall not be held responsible for such items failure to work, but will make every effort to correct any issues as reported as quickly as possible. Guest acknowledges that use of certain amenities may be potentially dangerous and involve risks if improperly used, particularly with children, and such use is at the Guest’s own risk.

Property will be delivered to Guest in a professionally cleaned condition. Upon termination of occupancy, Guest will deliver Property in the same condition less ordinary wear and tear.

It is the right and responsibility of all Guests to inspect the property upon arrival and to make note of any existing damages or dirty conditions. Guest is required to notify Owner of adverse property conditions within 24 hours of their arrival to ensure they are not held accountable for any pre-existing conditions. Reporting required repairs does not give Guest the right to cancel Agreement or receive a refund.

Guest shall use the Property for residential purposes only and in a careful manner to prevent any damage or loss to the Property and keep the Property in clean and sanitary condition at all times. Guests shall refrain from loud noise and shall not disturb, annoy, endanger, or inconvenience neighbors, nor shall Guest use the Property for any immoral, offensive or unlawful purposes, nor violate any law, association rules or ordinance, nor commit waste or nuisance.

Guest shall not make any alterations in or about the Premises including, but not limited to, moving furniture, painting, adding or changing locks, or using fastening devices. Guest agrees that fireworks and other hazardous materials shall not be used in or around Property, including candles and flammables.

Guest shall immediately notify Owner of any problem, malfunction or damage. Guest shall pay for all repairs or replacements for damages intentionally caused by Guests or through negligence, excluding ordinary wear and tear. Guest shall pay for such damage to the Premises as a result of failure to report a problem, (malfunction or damage) in a timely manner. Guest shall pay for repair of drain blockages or stoppages, unless caused by defective plumbing parts or tree roots invading sewer lines.

If Guest should fail to comply with the conditions and obligations of this Agreement, Guest shall surrender the Property, remove all Guests’ property and belongings and leave the Property in good order and free of damage. No refund of any portion of the Total Rental Fee shall be made, and if any legal action is necessary, the prevailing party shall be entitled to reimbursement from the other party for all costs incurred.


Guest agrees there shall be no hold overs or late departures without prior written approval. Hold overs by Guests shall be subject to a charge of up to 1½ times the daily prorated rent, (“Hold Over Rate”), plus any additional damages incurred including, but not limited to, the cost of alternative housing for guests displaced by Guests holding over. Late check-outs will be charged up to 50% of the Holdover Rate (“Late Check-Out Fee”).


Guest shall not assign or sublease any interest in the Property or permit the use of any portion of the Property by other persons who are not family members or guests of the Guest included as Authorized Guests on this Agreement, and within the number of permitted occupants. If this Agreement is assigned or the Premises or any part thereof is sublet, ) Guests are in breach of this Agreement and may be required to immediately leave the Premises, or be removed from it.


Owner Insurance: Personal property, including vehicles, of Guests, are not insured by Owner against loss or damage due to fire, theft, vandalism, rain, water, criminal or negligent acts of others, or any other cause. Owner does not insure against personal injury to Guest due to reasons other than the condition of the Property. Guest expressly recognizes that insurance coverage the Owner may maintain for personal injury, property damage or loss, does not cover the Guest. Owner recommends Guests carry or obtain insurance to protect themselves from any injury, loss or damage during their stay.

Indemnity and Hold Harmless: Guest agrees to indemnify and hold harmless Property Owners against any and all claims of personal injury or property damage or loss (including any costs, damages, liabilities, claims, legal fees and other actions) incurred by Guests arising from use of the Property regardless of the nature of the accident, injury or loss.


Emergencies: If owner has a reasonable belief that there is imminent danger to person or property, Owner may enter the Property without advance notice.

Inspections: If given reasonable cause, Owner has the right to inspect the premises without prior notice to verify that Guest has complied with and to enforce the terms of this Agreement. Should the Guest violate any of the terms of this agreement, the rental period shall terminate immediately with no refund of rents or deposits. The Guest waives all rights to process if they fail to vacate the premises upon termination of the rental agreement or rental period.

Repair: Owner has the right to enter the Property for the purpose of making necessary or agreed upon repairs, decorations, alterations, improvements, for maintenance, or to supply necessary or agreed services.

Showings: Owner reserves the right to enter the Property at reasonable times and with reasonable (24 hour) notice for the purposes of showing the Property to prospective buyers, renters, lenders, contractors or other authorized persons. If requested, Guest shall allow reasonable access of the Property between 9AM and 5PM, present or not.


In the event the Property is not available for use during the Rental Term due to reasons, events or circumstances beyond the control of Owner, NSSD will apply due diligence and good faith efforts to locate a replacement property that equals or exceeds the Property with respect to occupancy capacity, location and value that meets the reasonable satisfaction of the Guest. If such replacement property cannot be found and made available, Owner shall immediately return all payments made by the Guest, whereupon this Agreement shall be terminated and Guest and Owner shall have no further obligations or liabilities in any manner pertaining to this Agreement.


This Agreement contains the entire agreement between the parties with regard to the rental of the Property Any changes, amendments or modifications shall be void unless in writing and signed by both the Guest and the Property Owner. This Agreement shall be governed by the laws of the State of California. “Owner” or “Property Owner” shall include Next Stop: San Diego (NSSD) as Property Representative and Authorized Agent. “Guest” shall include Primary Contact plus other Authorized Guests, and in non-occupancy related cases, will apply to their respective heirs, successors, and representatives. The waiver or failure to enforce any breach or provision of this Agreement shall not be considered a waiver to other provisions. If any provision is held invalid, the remainder of the Agreement shall not be affected. Any notice required to be given under this Agreement shall be in writing and sent to the NSSD contact information included. Execution of a digital signature shall be deemed a valid signature.
